These Terms of Service ("Terms") govern your use of the My Nail Connection website and mobile application (the "Service") provided by My Nail Connection ("MNC," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
MNC is a discovery platform that helps clients find independent nail technicians and helps technicians showcase their work. MNC is not:
When you book or accept a booking through MNC, you are entering into a direct relationship with the other person. MNC provides the introduction and the tools; the service itself happens outside the Service and outside our control.
Every nail technician listed on MNC is an independent contractor, not an employee, agent, partner, or joint venturer of MNC. Technicians set their own prices, hours, services, cancellation policies, and standards. MNC does not direct, supervise, or control the means or manner of any service performed by a technician. Any agreement, dispute, payment, or liability arising out of a service is between the technician and the client.
MNC does not verify, vouch for, or guarantee any technician's credentials, licensing status, insurance, training, health or sanitation practices, or the quality or safety of any service performed. Each state, city, and locality sets its own rules for cosmetology and nail-technology licensing, and enforcement is the responsibility of the relevant licensing board, not MNC. Concerns about a technician's licensing should be directed to your local licensing authority.
Receiving nail services involves inherent risks, including but not limited to allergic reactions, skin or nail infection, physical injury, and damage to personal property. By using MNC to find or book a service, you knowingly and voluntarily assume all risks associated with the service. You agree that MNC is not responsible for any injury, illness, loss, or damage arising from a service you book, accept, or perform through the Service. If you have concerns about your health, allergies, or the cleanliness of a technician's workspace, confirm with the technician before your appointment and, if in doubt, decline the service.

We may remove content or suspend accounts that violate these Terms, with or without notice.
You keep ownership of the photos, text, and other material you upload ("Your Content"). By uploading Your Content, you grant MNC a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute Your Content within the Service and in reasonable promotion of the Service itself (e.g. social-media posts featuring the app). This license ends when you delete Your Content, except to the extent we've already shared it in cached or aggregated form.
You represent and warrant that you own or have the right to upload Your Content and that doing so does not infringe any third party's rights. If you upload a photo of a client's hands, you confirm that you have the client's permission.
Community posts. The What's happening board is shared with other users. We have no tolerance for objectionable content or abusive users there. Every post and reply can be reported, and any person can be blocked, from inside the app. We review every report and act on it within 24 hours, which may include removing the content and removing the person who posted it from the board or from the Service.
The Service, including its name, logo, design, code, and aggregated content other than Your Content, is owned by MNC and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, reverse-engineer, or create derivative works of the Service.
The Service integrates third-party services including Supabase, Stripe, geocoding and mapping providers, and email delivery. Your use of those services is also governed by their own terms and privacy policies. MNC is not responsible for the acts or omissions of third-party services.
You agree to indemnify, defend, and hold harmless MNC, its owners, officers, employees, contractors, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) any service you perform or receive in connection with another user, whether booked through the Service or otherwise.
The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. To the fullest extent permitted by law, MNC disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses, nor that any particular technician or client will meet your expectations.
To the fullest extent permitted by law, MNC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not MNC has been advised of the possibility of such damages.
MNC's total cumulative liability arising out of or related to these Terms or the Service, for any reason, will not exceed the greater of (a) the total amounts paid by you to MNC in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow exclusion of certain warranties or limitation of certain damages; in those jurisdictions, the above limitations apply only to the maximum extent permitted by law.
You may delete your account at any time by emailing anne@mynailconnection.com from the address on the account. We may suspend or terminate your account if you violate these Terms, if your account poses a risk to the Service or other users, or if required by law. Upon termination, your license to use the Service ends, and the provisions of these Terms that by their nature should survive will survive (including Sections 3–5, 7, 11–13, and 15–17).
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction. The Service is offered to users throughout the United States; the choice of Arizona law and venue applies regardless of the state in which you reside or use the Service.
We may update these Terms from time to time. When we make material changes, we will notify you through the Service, by email, or by updating the "Last updated" date above. Continued use of the Service after the changes take effect means you accept the updated Terms.
